Разумеется, я не считаю это работой. Но речь идет о том, как считает DoS/INS, когда их просят выдать/продлить визу. Если эту просьбу обосновывать тем, что вам нужен помощник по дому, который не будет получать деньги, но будет получать натурой (жильем, едой), то вполне логично, что с т.зр. властей это рассматривается как работа. Я в этом не уверен на 100%, просто предупреждаю, что надо проверить, чтобы не погореть на этом.

детали одного из описываемых мной случаев у вас в личке. разумеется обосновывать нужно не необходимостью помощи дома и присмотра за детьми.

Дорогой Determ, что вы имеете ввиду под "DoS/INS"?
Такого органа не существует. Если предположить что "DoS" - это department of labor (http://www.dol.gov/), то простите какое отношение этот департмент имеет а AOS application?. Непонятно.
Также не существует органа INS. Правильно он называется USCIS ( http://www.uscis.gov/).
Выдержка с сайта USCIS:
Once USCIS receives your visa petition (Form I-130, Petition for Alien Relative), it will be approved or denied. USCIS notifies the person who filed the visa petition of the petition was approved. USCIS will then send the approved visa petition to the Department of State's National Visa Center, where it will remain until an immigrant visa number is available. The Center will notify the foreign national when the visa petition is received and again when an immigrant visa number is available.

Как только immigrant visa number is available можно подавать AOS...
Не пойму при чем тут department of labor.....

DoS - это Department of State (и я не пойму, причем здесь department of labor ), INS - это сокращенно USCIS
Вот ситуация, которую в этой теме обсуждают:
"The immediate relatives of U.S. citizens, which includes parents, spouses and unmarried children under the age of 21, do not have to wait for an immigrant visa number to become available once the visa petition filed for them is approved by USCIS. An immigrant visa number will become immediately available."
"If you are already in the United States, you may apply to change your status to that of a lawful permanent resident after a visa number becomes available to you. "
Т.е. формы I-130 и I-485 можно отправлять одновременно.
